The court of appeal sitting in Abuja, the federal capital has ordered the Academic Staff Union of Universities (ASUU) to direct its members to resume work immediately before seeking to appeal the judgement of the National Industrial Court (NIC).
The court on Friday said ASUU should obey the judgement of the NIC directing it to call off its seven-month-old strike before it can appeal against the judgement.
The NIC on September 21 had delivered a judgement against ASUU directing the union members to return to classrooms.
Not satisfied with the ruling of the NIC, ASUU through its lawyer, Femi Falana, had approached the court of appeal seeking leave to challenge the court judgement.
Delivering a ruling at the resumed court session on Friday, a three-member panel of the appellate court granted the union “conditional leave” to appeal the industrial court’s decision.
The panel led by Hamman Barka said for ASUU to file its notice of appeal within seven days, it must show evidence that its members have resumed work immediately.
The panel held that failure to adhere to the order will make the appeal incompetent before the court of appeal.
ASUU has been on indefinite strike since February 14.
The federal government and ASUU executives had met times without a number but failed to agree as their several meetings ended in deadlocks.
